Frequently Asked Questions
What should I do if I’m arrested or charged with a crime?
If you’re arrested, remain calm and exercise your right to remain silent. Do not answer questions or provide statements to law enforcement without an attorney present. Contact Noel Law immedietly in order to protect your rights and begin building your defense.
Do I need a lawyer even if I’m innocent?
Yes. Innocence does not guarantee a dismissal or acquittal. The criminal justice system is complex, and having an experienced defense attorney ensures your rights are protected and that your side of the story is effectively presented.
What’s the difference between a misdemeanor and a felony?
A misdemeanor is a less serious crime, typically punishable by up to one year in jail and/or fines. A felony is more serious and can result in prison time exceeding one year, larger fines, and long-term consequences like loss of civil rights and job restrictions.
Am I required to take a breathalyzer test in Indiana?
Under Indiana’s implied consent law, if you’re lawfully arrested for DUI (called Operating While Intoxicated, or OWI), you are required to submit to a certified chemical test. Refusal can result in a one-year license suspension for first offenses, and two years for subsequent refusals, regardless of whether you’re convicted in court.
What are the penalties for a first OWI offense in Indiana?
A first-time OWI in Indiana is typically a Class C misdemeanor, punishable by up to 60 days in jail, a fine up to $500, and a license suspension of up to 2 years. Penalties increase with aggravating factors such as a BAC of 0.15% or higher, accidents, or minors in the vehicle.
